Protect the family home from care fees -
The loss of the family home is of growing concern to millions, as people live longer and care fees increase. Unless an individual qualifies for ‘continuing care’ – an unpredictable process at best – the NHS will not pay for care home fees, the average of which is £28,600 every year. If you have more than £24,000, you have to pay those fees yourself. Giving away money or property can be treated as the ‘deliberate deprivation of assets’, so you would still be regarded as owning those assets. The council would then refuse to pay.
What then can you do?
• Money or property given away years in advance, at a time when care is not on the horizon, should present no problem. Trusts are a long-established and effective way of placing assets outside your estate, and also reducing tax.
• If the property is in just your name, and not your spouse’s as well, get it transferred into joint names.
• If you have lost your spouse, and you want your children to inherit, transfer the property into the name of your children and yourself. Providing this is done in the right way, your son or daughter will automatically inherit the whole of the property on your death.
• Investment bonds can be a vital part of avoiding the problem. They are technically life assurance contracts – though in practice a good way of investing – the value of the investment is disregarded.
